This Privacy Policy discloses Herbs, Etc.’s (“Herbs Etc.,” “us,” or “we”) collection, use and sharing practices for personal information provided by and collected about visitors to and users of (collectively, “you” or a “user”) the herbsetc.com (the “Site”).
Herbs, Etc. receives and stores any information you enter on our Site, or provide to Herbs, Etc. in any other way, such as email communication through the site.

Information We Automatically Collect
Cookies
When you visit the Site, Herbs, Etc. may send one or more cookies— a small text file containing a string of alphanumeric characters sent to your computer that uniquely identifies your browser. The cookie is a randomly generated number that temporarily resides on your computer.
The cookie itself does not actually identify a user, just the particular computer session that the user uses to access the Site. Unless you voluntarily identify yourself, we won’t know who you are, even if we generate a cookie for your particular Site session. Log File Information Collection
When you use the Site, Herbs, Etc.’s servers automatically record certain information that your Web browser sends whenever you visit any website. These server logs may include information such as your Web request, Internet Protocol (“IP”) address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.
Information You Expressly Provide to Herbs, Etc.
If you buy something from our store, we need more specific information about you. To process your order and ship the merchandise you selected, we need your personal data such as your first and last name, your email address and your shipping and billing address. We also use your contact and order information to send you communication related to the processing of your order. We will ask you to provide this information in our “check out page” before letting you finalize your purchase with the payment.
Herbs, Etc. Accounts
You can sign up for an account if you would like. We will remember your information and, when you decide to buy our products, you do not have to provide all of your information over again – you just have to log in. Before registering your account, we will ask you to expressly provide your consent to this privacy policy. Only if you give us your consent, will we open your account. We also give you the possibility to easily withdraw your consent and delete your account.
Partial Purchases Made Through the Site
If you have selected and started to purchase one or more of our products, but have not completed the purchase, you may have provided partial information, such as your email. In that case, we might send you an email to remind you about your interest. If you are not comfortable in receiving further emails of this kind, we will give you an opportunity to opt out.
Writing a Product Review
When you complete a purchase, we will email you to ask you to review the product you bought. This is entirely optional.
How We Use Your Information
Herbs, Etc. may use your email address or other personally identifiable information to contact you regarding your interest in Herbs, Etc. available products and to communicate with you regarding any requested information as disclosed within the form or registration. You will have the ability to opt out of such contacts by following the unsubscribe instructions at the bottom of the email. Herbs, Etc. may also use your email address or other personally identifiable information for non-marketing or administrative purposes (such as notifying you of Site changes or for customer service purposes). Herbs, Etc. will treat such personally identifiable information as confidential while it is in Herbs, Etc.’s possession. However, standard email and online forms are not secure. It is possible that your information can be viewed or retrieved by others when transmitted via the Internet without Herbs, Etc.’s knowledge or authorization.
In operating our store, it is essential for us to capture some information about your device, such as your IP address and information related to your visit, when you browse our store. SMS Marketing & Mobile Compliance
Herbs, Etc. may collect mobile phone numbers through the Site and other locations for the purpose of sending transactional and marketing messages via SMS. By providing your mobile number, you consent to receive text messages related to your shopping activity, including cart reminders, order updates, and promotional offers through the use of automated systems and artificial intelligence.
We do not share SMS opt-in data or consent with any third parties. The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Information Disclosures
Herbs, Etc. may provide personally identifiable information and non-personally-identifiable information to our contractors for the purpose of providing and maintaining our services or fulfilling your request or registration. Herbs, Etc. requires that our contractors agree to use such information solely for this purpose and uses reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.
Herbs, Etc. may release personally identifiable information and/or non-personally-identifiable information:
- If required to do so by law,
- In the good faith belief that release or disclosure of such information action is necessary to comply with state, federal, and international laws or respond to a court order, subpoena, or search warrant,
- In connection with a proposed or actual business transaction involving Herbs Etc, such as a merger, acquisition, bankruptcy or liquidation, in which cases all data collected from and about users and visitors to the Site will be considered an asset of Herbs Etc.

Security
When you submit sensitive information that information is encrypted and protected by encryption software– Rapid SSL (Secured Socket Layer). We also use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use or disclosure once we receive it. While on a secure page, the ‘http’ on our browser changes to ‘https’.
All information gathered on the Site is stored within an Herbs, Etc. -controlled database accessible only to Herbs, Etc. and its specifically authorized contractors. However, as effective as any security measure implemented by Herbs, Etc. may be, no security system is impenetrable. We cannot guarantee the complete security of our database, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet. Changes to Herbs, Etc.’s Privacy Policy
Herbs, Etc. may change our privacy policy from time to time. If we change this privacy policy at some point in the future, we will post the changes to the Site. Your continued use of the Site constitutes your agreement to this Privacy Policy and any future revisions. Our use of information gathered while the current privacy policy is in effect will always be consistent with the current policy, even if we change that policy later.
Updating, Changing or Deleting Your Information
If you want to access, update or delete your personal information from Herbs, Etc.’s systems, please send an email to mailorder@herbsetc.com. We will confirm your request promptly after receiving it, but there may be some lag time between the time you notify us and the time Herbs, Etc.’s systems are updated. Despite such delay, we will comply with your request in accordance with the law of your jurisdiction. We may reject a data deletion request as permitted by the laws in your jurisdiction. Further, Herbs, Etc. may maintain a copy of such information in our archives and records.
Note About Children
The Site is not intended for or directed to children under the age of 13. If we become aware that a person under the age of 13 has provided us with their personal information, we will immediately delete such information from our systems.
Protecting your privacy is important to us. Since Herbs, Etc. began back in 1971, we have never shared, rented or sold any customer information to any other party.

The Herbs, Etc. mobile message service (the "Service") is operated by Herbs, Etc. (“Herbs, Etc.”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Herbs, Etc.’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Herbs, Etc. through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Herbs, Etc.. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
